Terms of Service
1. Agreement to Terms
By accessing or using rikuhealth.com or any services provided by Riku Health MSO, LLC ("Riku Health," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
These Terms apply to all visitors, patients, and others who access or use our platform. Clinical services are provided by a licensed California Professional Corporation, not by Riku Health MSO, LLC directly.
2. Description of Services
Riku Health is a telehealth management platform that facilitates access to licensed healthcare providers for:
• ADHD evaluation, diagnosis, and medication management • Behavioral health care, including anxiety and depression treatment • Medically supervised weight management, including GLP-1 prescribing
All clinical services are provided by independently licensed physicians and nurse practitioners. Riku Health MSO, LLC provides administrative, technology, and operational support under a Management Services Agreement.
3. Eligibility
You must be at least 18 years of age to use our services. Our telehealth services are currently available in supported states; contact us to confirm availability in your state. By using our services, you represent and warrant that you meet these eligibility requirements.
4. Telehealth Informed Consent
By scheduling an appointment through our platform, you acknowledge and consent to receiving healthcare services via telehealth (videoconference). You understand that:
• Telehealth has limitations compared to in-person care. In some cases, your provider may determine that an in-person evaluation is necessary. • Technical failures may disrupt a telehealth session. If a session is interrupted, your provider will contact you via the phone number on file. • Controlled substances (including stimulant medications) may be prescribed via telehealth only after a thorough clinical evaluation and in compliance with DEA telemedicine prescribing rules, applicable state law, and the clinical judgment of a licensed prescriber. Not all patients will qualify. Certain prescriptions may require additional clinical documentation or, in some circumstances, an in-person evaluation. • Your clinical records will be maintained in accordance with HIPAA and California law.
5. Appointment Scheduling and Cancellation
Appointments are scheduled through our SimplePractice patient booking system. We ask that you provide at least 24 hours' notice to cancel or reschedule an appointment. Late cancellations or no-shows may be subject to a cancellation fee at the discretion of your provider.
Appointment availability is subject to provider scheduling and is not guaranteed.
6. Fees and Payment
Our current subscription fee is $99 per month, which covers ongoing care management. Initial evaluation and specific service fees are disclosed prior to booking. Fees are subject to change with reasonable notice.
Payment is processed through Stripe, Inc. By providing payment information, you authorize us to charge the applicable fees. All fees are in U.S. dollars.
Under the No Surprises Act (42 U.S.C. §300gg-131), you have the right to receive a Good Faith Estimate of expected charges for non-emergency healthcare services scheduled at least 3 business days in advance. Contact us at hello@rikuhealth.com to request a Good Faith Estimate before your appointment.
Insurance billing may be available for certain services. You are responsible for understanding your insurance coverage. We make no guarantee of insurance reimbursement.
7. Not Emergency Services
Our platform does not provide emergency medical services. If you are experiencing a medical emergency, call 911 immediately. If you are in a mental health crisis, call or text 988 (Suicide and Crisis Lifeline) or go to your nearest emergency room.
8. Patient Responsibilities
You agree to:
• Provide accurate, current, and complete information about your health history. • Disclose all medications, supplements, and substances you are using. • Use medications only as prescribed and not share prescriptions with others. • Maintain the confidentiality of your account credentials. • Comply with applicable federal and state laws regarding any controlled substances prescribed.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Riku Health MSO, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of our platform. Our total liability to you for any claim shall not exceed the amount you paid to us in the three months preceding the claim.
Nothing in these Terms limits liability for gross negligence, fraud, or any liability that cannot be excluded by law.
10. Intellectual Property
All content on rikuhealth.com, including text, graphics, logos, and software, is the property of Riku Health MSO, LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Effective Date" at the top of this page. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Sacramento County, California.
